Welcome to AppForADayTM ("Company," "we," "our," or "us"). By clicking "Create Your Shop," "Create Your Event," "Create," or otherwise accessing or using our mobile application and web platform (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR SERVICES.

1. Description of Services

AppForADayTM provides digital tools for temporary event and commerce management, including but not limited to:

  • The Hustle: Tools for managing pop-up shops, inventory, and payment links.
  • The Socialite: Tools for event management, photo sharing, guestbooks, and gift registries.
  • The Tribute: Tools for creating shared digital memorials to celebrate the life of a loved one.

2. User Accounts and Eligibility

  • Eligibility: You must be at least 13 years old to use the Services. If you are under 18, you represent that you have your parent or guardian’s permission to use the Services.
  • Account Security: You are responsible for maintaining the confidentiality of your "Admin PIN" and event links. You are fully responsible for all activities that occur under your event or shop pages.

3. User-Generated Content (UGC)

  • Ownership: You retain ownership of the photos, videos, text, and data ("Content") you upload.
  • License to Us: By uploading Content, you grant AppForADayTM a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your Content solely for the purpose of providing the Services.
  • Prohibited Content: You agree not to upload Content that is illegal, offensive, pornographic, infringing on copyrights, or promotes hate speech. We reserve the right to remove any Content immediately without notice.

4. Commerce and Payments (The Hustle)

  • No Payment Processing: AppForADayTM is not a bank, payment processor, or money transmitter. We solely provide links to third-party services (Venmo, CashApp, Zelle).
  • Sole Responsibility: All transactions are strictly between the Buyer and Seller. AppForADayTM is not a party to these transactions.
  • Disclaimer: We are not liable for failed payments, chargebacks, fraud, defective items, or disputes between buyers and sellers.
  • Taxes: You are solely responsible for calculating, collecting, and remitting any applicable taxes arising from your sales.

5. Memorials & Donations (The Tribute)

  • Stripe Connect: To facilitate donations for memorial funds, AppForADayTM integrates with Stripe Connect Express. By setting up a memorial fund, you agree to the Stripe Connected Account Agreement. AppForADayTM is not a bank, payment processor, or money transmitter and does not hold funds at any point.
  • Liability: All donation transactions are strictly between the Guest (Donor) and the Host (Family/Recipient). We are not a party to these transactions and are not liable for refunds, chargebacks, fraud, or any disputes related to donations.
  • Forever Archive: The "Forever" hosting upgrade for The Tribute retains memorial data for the lifetime of the AppForADayTM service, subject to business continuity and the terms outlined in our Data Retention policy.

6. AI Features and Disclaimers

Our Services use Artificial Intelligence (AI) for features including Bio Summaries, TTL Suggestions, and Gift Registries.

  • Accuracy: AI output is generated automatically and may be inaccurate or hallucinated. You should verify all AI suggestions before relying on them.
  • Gift Registry: Product links generated by our system are for convenience. We do not guarantee stock availability, price accuracy, or product quality.

7. Affiliate Disclosure

AppForADayTM participates in affiliate marketing programs (e.g., Amazon Associates, Target, Walmart). We may earn commissions on purchases made through links in our Gift Registry or other features. This does not affect the price you or your guests pay.

8. Event Liability (The Socialite)

AppForADayTM provides digital tools only. We are not an event organizer or venue.

  • We are not liable for any physical injury, property damage, or disputes occurring at any real-world event associated with our platform.
  • We are not responsible for guests who fail to RSVP or guests who RSVP but do not attend.

9. Limitation of Liability

To the fullest extent permitted by law, AppForADayTM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. In no event shall our aggregate liability exceed the greater of one hundred U.S. dollars ($100.00) or the amount you paid us in the past six months.

10. International Use & Export Controls

10.1 Operations: The Services are controlled and operated by AppForADayTM from its offices in the United States. We make no representation that the Services are appropriate or available for use in other locations. Those who choose to access the Services from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

10.2 Void Where Prohibited: You may not use the Services if you are a resident of a country embargoed by the United States, or are a foreign person or entity blocked or denied by the United States government.

10.3 Tax Compliance: If you use "The Hustle" or "The Tribute" to solicit funds or sell items outside of the United States, you are solely responsible for calculating, collecting, reporting, and remitting any applicable taxes (VAT, GST, Sales Tax) to your local tax authorities. AppForADayTM is not a marketplace facilitator and does not collect taxes on your behalf.
